Terms of Service

1. Acceptance of Terms
By accessing or using NexusQA ("Service"), operated by Adverant Limited ("Adverant", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
NexusQA is an AI-native quality assurance platform that provides automated testing across 10 paradigms, autonomous bug remediation, regression prediction, and quality metrics aggregation. The Service runs on the Nexus Backplane and integrates with your existing CI/CD and GitHub workflows.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
4. Subscription and Billing
4.1 Plans
NexusQA offers four tiers: Starter ($99/mo), Professional ($299/mo), Enterprise ($799/mo), and Unlimited (custom pricing). Annual billing provides a 20% discount on Professional and Enterprise tiers.
4.2 Free Trial
New accounts receive a 14-day free trial on the Professional tier. No credit card is required for the trial. At the end of the trial, your account downgrades to read-only mode. No data is deleted during the trial-to-paid transition.
4.3 Billing
Subscriptions are billed in advance on a monthly or annual basis. All fees are in US dollars and are non-refundable except as required by applicable law. We do not offer prorated refunds for mid-cycle cancellations.
4.4 Credits
AI triage and remediation credits are consumed per-operation as described in your plan. Unused credits do not roll over to the next billing period. Credit consumption is visible in real-time through the quality scorecard.
5. Your Data
5.1 Ownership
You retain all rights to your data including test suites, test cases, screenshots, recordings, tickets, and quality metrics. Adverant does not claim ownership of your content.
5.2 License to Adverant
You grant Adverant a limited, non-exclusive license to process your data solely for the purpose of providing the Service. This includes sending code context to your configured AI provider for triage and remediation operations.
5.3 Data Export
You may export your data at any time via the NexusQA API. Upon cancellation, you have 30 days to export all data before permanent deletion.
6. Acceptable Use
You agree not to:
- Use the Service to process data you do not have rights to test
- Use security testing features (OWASP ZAP) against systems you do not own or have explicit authorization to test
- Attempt to circumvent organization-level access controls or tenant isolation
- Reverse-engineer, decompile, or disassemble the Service (note: the platform is Apache 2.0 licensed; this restriction applies to proprietary service infrastructure only)
- Use the Service for any illegal purpose
- Resell access to the Service without written authorization
7. AI-Generated Content
NexusQA uses AI to generate triage classifications, remediation plans, test scripts, and fix implementations. All AI-generated content is subject to the 7-stage pipeline with mandatory human review (Stage 7). Adverant does not guarantee the correctness, security, or fitness of AI-generated code. You are responsible for reviewing and approving all changes before they reach production.
8. Service Level Agreement
Enterprise and Unlimited tier customers receive a 99.9% uptime SLA for the NexusQA API. Downtime excludes scheduled maintenance (with 48-hour notice), force majeure events, and issues caused by your infrastructure. SLA credits are applied to the next billing cycle — not refunded.
9. Limitation of Liability
To the maximum extent permitted by law, Adverant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Open Source
NexusQA is licensed under Apache License 2.0. The source code is available at github.com/adverant. The Apache 2.0 license applies to the platform code. These Terms of Service apply to the hosted Service operated by Adverant.
11. Termination
Either party may terminate the subscription at any time. You may cancel through the dashboard settings. We may terminate your account for material breach of these terms with 30 days written notice. Upon termination, your access ends immediately and you have 30 days to export data.
12. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be resolved in the courts of Dublin, Ireland, except where consumer protection law in your jurisdiction requires otherwise.
13. Changes to Terms
We may modify these Terms with 30 days notice via email or in-app notification. Material changes will not apply retroactively. Continued use after the effective date constitutes acceptance.
